Liability Waiver & Release of Claims (reference copy)

I. Assumption of Risk

1. Voluntary Participation

I understand that reformer Pilates, apparatus-based fitness, and all related activities offered at Couture Pilates involve inherent physical risk, including but not limited to muscle strain, ligament injury, joint stress, falls, cardiovascular events, and aggravation of pre-existing conditions. I voluntarily and knowingly accept all such risks.

2. Physical Condition

I represent that I am in adequate physical condition to participate in Couture Pilates programming. I have disclosed all known injuries, conditions, limitations, and relevant medical history on my Client Registration & Health Form, which is incorporated herein by reference. I understand that failure to make complete disclosure increases my risk of injury.

3. Physician Clearance

Couture Pilates strongly recommends that I obtain physician clearance before beginning any exercise program, particularly if I have pre-existing health conditions, am pregnant or postpartum, have been sedentary, or am over the age of 40. I represent that I have either obtained such clearance or waived it at my own discretion.

II. Release & Indemnification

4. Release of Liability

To the fullest extent permitted by applicable law, I hereby release, discharge, and agree to hold harmless Couture Pilates Clinton, LLC, and Couture Pilates Holdings, LLC, its subsidiaries, officers, owners, directors, employees, instructors, and agents (collectively, the "Released Parties") from any and all claims, demands, damages, losses, liabilities, and expenses of any kind — whether arising from negligence, premises liability, equipment failure, instruction, or otherwise — that arise out of or relate to my participation in Couture Pilates activities. This release does not extend to claims arising from gross negligence or willful misconduct.

5. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, damages, or legal fees arising from my conduct, actions, or participation in Couture Pilates activities, including any injury I cause to another participant or damage I cause to studio equipment or property.

III. Specific Acknowledgments

6. Equipment Use

I agree to follow all instructor directions and safe equipment use guidelines at all times. I will inspect equipment before use and immediately notify studio staff of any damage, malfunction, or unsafe condition. I understand that improper use of reformers and other apparatus materially increases the risk of injury.

7. Age Requirement

I confirm that I am at least 16 years of age. I understand that participants aged 16–17 must have a parent or legal guardian execute a separate minor's addendum to this waiver in person before any participation is permitted.

8. Personal Property

Couture Pilates is not responsible for the loss, theft, or damage of any personal property brought onto or stored at studio premises.

9. Instructor Changes

Couture Pilates reserves the right to substitute instructors at any time without prior notice. Such substitutions do not entitle a participant to a refund or credit.

IV. Photography & Media Consent

10. Media Release

I understand that Couture Pilates may photograph or record studio classes and activities for use in marketing, social media, educational materials, and promotional content. I grant Couture Pilates a non-exclusive, royalty-free, perpetual, worldwide license to use my name and likeness in such materials. Couture Pilates' practice is to honor requests to stop using a particular image where reasonably possible; requests may be sent in writing to studio management. Content I post publicly and tag or mention Couture Pilates in is separately governed by Section 16 of our Terms and Conditions.

11. Security Surveillance Acknowledgment

Client acknowledges that Couture Pilates Clinton, LLC maintains video and audio surveillance covering the entrances and studio floor for the safety and security of clients, staff, and property. There are no cameras or microphones in restrooms or changing areas. This surveillance is separate from and independent of any media or marketing release provided elsewhere in this agreement and may be used for quality improvement and training. By signing below, Client consents to being recorded while present in the studio.

V. Policies Acknowledgment

I have separately received, read, and agree to be bound by the Couture Pilates Studio Policies, which governs cancellations, no-shows, refunds, age requirements, membership terms, studio conduct, and all related operational policies. I understand that violation of studio policies may result in financial penalties, forfeiture of class credits, or termination of membership without refund.

VI. General Provisions

12. Severability

If any provision of this Agreement is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey. Any dispute arising under this Agreement shall be resolved exclusively in the courts of Hunterdon County, New Jersey.

14. Entire Agreement

This Liability Waiver, together with the Couture Pilates Studio Policies and Client Registration Form, constitutes the complete and entire agreement between the parties regarding participation and supersedes all prior representations, discussions, or understandings.

15. Modification

Couture Pilates reserves the right to update its policies and waiver terms. Clients will be notified of material changes and may be required to execute an updated waiver.

BY REVIEWING AND CHECKING, I CONFIRM THAT I HAVE READ THIS ENTIRE AGREEMENT, THAT I UNDERSTAND ITS CONTENTS, AND THAT I AM SIGNING IT FREELY AND VOLUNTARILY. I AM AT LEAST 18 YEARS OF AGE, OR I AM 16 OR 17 AND A PARENT OR LEGAL GUARDIAN HAS SIGNED THE MINOR PARTICIPANT ADDENDUM IN PERSON, ACKNOWLEDGING AND ACCEPTING ALL TERMS OF THIS LIABILITY WAIVER ON BEHALF OF THE MINOR PARTICIPANT AND AGREEING TO BE PERSONALLY BOUND BY THE RELEASE AND INDEMNIFICATION PROVISIONS HEREIN.

Minor Participant Addendum (Participants Ages 16–17 Only)

This section must be completed in person at the studio. A parent or legal guardian must be present and must sign below. By signing, the parent/guardian acknowledges and accepts all terms of this Liability Waiver on behalf of the minor participant and agrees to be personally bound by the release and indemnification provisions herein.

This waiver is effective upon signature and remains on file for the duration of your participation at Couture Pilates.
